1. Who we are
Jiu Jitsu Brotherhood is owned and operated by Kingston Jiu Jitsu Ltd, a company registered in England and Wales under company number 11578178. Our registered office is 56 Staunton Road, Kingston upon Thames, Surrey, England, KT2 5TL.
In these Terms, “Jiu Jitsu Brotherhood”, “JJB”, “we”, “us” and “our” refer to Kingston Jiu Jitsu Ltd trading as Jiu Jitsu Brotherhood.
You can contact us at admin@kingstonjiujitsu.com or on 07584 131335.
These Terms apply to your use of this website and to orders placed through it. Please read them before using the website or placing an order.
2. Using this website
You may use this website only for lawful purposes. You must not:
- misuse, disrupt or attempt to gain unauthorised access to the website or its systems;
- knowingly introduce malicious code or harmful material;
- use automated tools to extract, scrape or reproduce website content for commercial purposes without our written permission;
- infringe our intellectual property rights or those of another person; or
- use the website in a fraudulent, abusive or unlawful way.
We may suspend or restrict access where reasonably necessary to protect the website, its users or our rights.
We aim to keep the website available and accurate, but do not guarantee that it will always be available, uninterrupted or error-free. We may change, suspend or withdraw any part of it when reasonably necessary.
3. Information and training content
Articles, videos, techniques, training advice and other content published on Jiu Jitsu Brotherhood are provided for general information and educational purposes. They are not a substitute for individual medical, physiotherapy, coaching or other professional advice.
Brazilian Jiu Jitsu, grappling, strength training and other physical activities involve inherent risks of injury. You are responsible for deciding whether an activity is appropriate for you, taking account of your health, experience and circumstances. Seek appropriately qualified professional advice if you are unsure. Stop exercising and seek appropriate assistance if you become unwell or injured.
Nothing in these Terms excludes or restricts liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.
4. Intellectual property
Unless stated otherwise, the website and its original content, including articles, photographs, illustrations, videos, graphics, branding, logos, page designs and downloadable material, are owned by or licensed to Kingston Jiu Jitsu Ltd and are protected by intellectual property law.
You may view the website and download or print reasonable extracts for your personal, non-commercial use. You must not reproduce, republish, sell, license, distribute, modify, commercially exploit or systematically extract our content without our written permission.
Where a contributor or other rights holder is identified, their rights remain reserved. “Jiu Jitsu Brotherhood”, the Ouroboros branding and associated logos may not be used in a way that suggests endorsement, affiliation or permission where none exists.
5. Third-party links and content
The website may link to websites, videos, social networks or services operated by other organisations. These links are provided for information or convenience. We do not control third-party websites and are not responsible for their content, availability, security or privacy practices.
6. Products and availability
We make reasonable efforts to ensure that product descriptions, photographs, prices, colours, measurements and sizing information are accurate. Colours and appearance may vary slightly between screens, and handmade or batch-produced products may have minor variations.
All products are subject to availability. We may limit quantities, withdraw a product or correct an obvious error before accepting an order.
7. Prices and payment
Prices are shown in pounds sterling and include VAT where applicable. Delivery charges, if any, are shown before you place your order.
Payment is taken through Mollie or another payment provider identified at checkout. We do not store your full payment card details. Your payment may be subject to the payment provider's terms and security checks.
If a price or other important product detail is obviously incorrect, we may reject or cancel the affected order and refund any payment made.
8. Placing an order and formation of the contract
Our checkout allows you to review and correct your order before submitting it. By placing an order, you offer to buy the products shown in your basket under these Terms.
An automated acknowledgement confirms that we have received your order. It does not mean that we have accepted it. A contract is formed when we send an order acceptance or dispatch confirmation, whichever occurs first.
We may decline or cancel an order before acceptance, for example if:
- a product is unavailable;
- payment is not authorised;
- we cannot deliver to the address supplied;
- the order appears fraudulent or unlawful;
- a purchase or quantity restriction applies; or
- there is an obvious error in the price or description.
If we cancel after taking payment, we will refund the amount paid.
9. UK-only sales and delivery
We currently accept orders for delivery to UK addresses only. We do not accept orders for delivery outside the United Kingdom.
Available delivery methods, charges and estimates are displayed at checkout. Unless a different period is agreed, we will deliver without undue delay and within 30 days after the contract is formed.
Further information is set out in our Delivery & Returns Policy, which forms part of these Terms.
10. Ownership and responsibility for goods
You are responsible for the goods from the time they are delivered to you or to a person you nominate to receive them. Ownership passes to you when we have received payment in full and the goods have been delivered.
11. Cancellation, returns and refunds
For most goods bought online, consumers have a legal right to cancel within 14 days after receiving them, without giving a reason. After notifying us, you normally have a further 14 days to return the goods.
Exceptions may apply, including to genuinely personalised or custom-made goods and sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed.
Your cancellation rights, return instructions and refund arrangements are explained in our Delivery & Returns Policy. That policy does not affect your statutory rights.
12. Faulty, damaged or incorrect goods
Goods must be as described, of satisfactory quality and fit for purpose. If an item is faulty, damaged, not as described or incorrect, please contact us promptly. We will provide the remedy required by law, which may include repair, replacement, price reduction or refund depending on the circumstances.
Nothing in these Terms limits your rights under the Consumer Rights Act 2015 or other applicable consumer law.
13. Discount codes and promotions
Discount codes and promotions may be subject to additional conditions shown at the time. Unless stated otherwise, they cannot be exchanged for cash, used after expiry or combined with another offer. We may withdraw or refuse a promotion where it has been misused, obtained fraudulently or published in error, without affecting orders already validly accepted.
14. Our responsibility to you
We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is an obvious consequence of our breach or was contemplated by both you and us when the contract was formed.
We are not responsible for loss or damage that is not foreseeable, or for business losses suffered by a consumer. If you use products or website content for commercial or business purposes, our liability will be subject to any separate written agreement applying to that use.
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
15. Events outside our reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control. If such an event materially affects your order, we will contact you where reasonably possible and take reasonable steps to minimise the effect. Your statutory rights remain unaffected.
16. Personal information
We use personal information as described in our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy.
17. Changes to these Terms
We may update these Terms to reflect changes in our services, technology, business or legal obligations. The Terms applying to an order are those made available when the order was placed, unless a change is required by law.
18. If part of these Terms is invalid
Each paragraph operates separately. If a court or relevant authority finds any part unlawful or unenforceable, the remaining parts will continue in effect.
19. No waiver and third-party rights
If we delay enforcing a right, that does not waive it. No person other than you and us has a right to enforce these Terms, except where the law provides otherwise.
20. Governing law and disputes
These Terms are governed by the law of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory protections given by the law of the part of the UK in which you live and may bring proceedings in the courts available to you under applicable law.
Please contact us first so that we can try to resolve any concern directly.
